Introduction

Thank you for using the keptwoman.net service and related products, services and features (hereinafter collectively referred to as the “Service”).

Service

A service is a platform on which users can find and watch text, photos, videos and other content, publish their own materials, as well as communicate with each other and share news and ideas. For authors and advertisers, the platform also provides the ability to display and distribute photos and ads. For detailed information on our products and how to use them, please visit the Help Center. It contains, among other things, information about the Affiliate Program and paid subscriptions and paid content on keptwoman.net. In addition, the Help Center provides information on how to use the site on different devices, such as a TV, game console.

Service provider

The service provider of the Service is keptwoman.net social group, whose activities are carried out in accordance with applicable law.

Applicable conditions

Use of the Service is governed by these terms, the keptwoman.net Community Principles and the requirements set out in our Help Center section Rules, Security and Copyright. These rules are collectively referred to as the “Agreement”. If you provide advertising, sponsorship, or add direct advertising or product placement to Content, your actions are also governed by the Advertiser Policies.

We ask you to carefully read the Agreement. If you do not understand or do not accept any of its parts, you cannot use the Service.

Who can use the Service?

Age restrictions

The service can only be used by persons over 18 years of age.

Persons from 16 to 18 years old can use it with the permission of a parent or legal guardian, as well as in cases of obtaining legal capacity on a legal basis.

Parent or guardian permission

If you are over 16 but under 18, you must not use the Service without parental or guardian consent. Ask them to read this Agreement with you.

If you are a parent or guardian of a user under the age of 18, then by allowing a child to use the Service, you agree to comply with the terms of the Agreement and be responsible for the actions that your child takes in the Service.

Companies

If you use the Service on behalf of a legal entity or individual entrepreneur, you confirm that you have the authority to act on behalf of this legal entity or individual entrepreneur and that this legal entity or individual entrepreneur accepts the terms of the Agreement.

Use of the Service

Service Content

The Service Content includes video, audio (for example, music and other sounds), graphics, photographs, text (for example, comments and scripts), branding elements (including brand names, trademarks, service marks and logos), interactive features , software, records and other materials provided by you, keptwoman.net or third parties (collectively, “Content”). Content can be provided and distributed in the Service by our users, while keptwoman.net is a hosting provider for such Content. The individual or legal entity who uploaded it to the Service is responsible for the Content. If you find that the Content does not comply with this Agreement, for example, it violates the Community Guidelines or any law, you can tell us about it.

Accounts

You can use some features of the Service, such as search and view Content, without an account. However, an account is required to access more features. For example, if you are logged into your account, you can subscribe to news channels and create your own, put “like” marks on any materials and perform other actions. If you create an account, you will have access to additional features of the Service. For example, you can upload photos and videos, leave comments and create communities. Learn how to create a community in this article.

To keep your account secure, do not share your password with anyone or reuse it in third-party applications. About account security and what to do if your password or account was used unauthorizedly, is written in this article.

Your information

Information on how we collect and process your personal data, as well as ensure its security when you use the Service, is given in our Privacy Policy. In addition, the Privacy Notice provides additional information about the privacy practices the service takes.

All audio and audiovisual material uploaded to the Service is subject to the Data Processing Terms. They do not apply only in cases where you add such content solely for personal purposes.

Permissions and restrictions

You can access and use the Service provided that you comply with the requirements of the law and this Agreement. Reading, watching and listening to the Content is permitted only for personal, non-commercial purposes.

To use the Service, you must comply with the specified restrictions. It is prohibited to do the following:

View, copy, download, distribute, transmit, broadcast, display, sell, license, modify, transform or in any way use the Content or any part of the Service, except as indicated. To perform these actions, the following is required: a) permission by the rules of the Service; b) prior written permission from keptwoman.net representatives and, if necessary, the respective copyright holders; c) permission in accordance with applicable law.
Do (or attempt to do) the following actions: bypass restrictions, disable, perform fraudulent manipulations or otherwise interfere with the operation of the Service, including security-related features, as well as features that: a) prevent or restrict the use or copying of any Content ; b) impose restrictions on the use of the Service or Content.
Use the Service through automated means such as bots, botnets, and content collectors. Exceptions: a) bots of public search networks that work in accordance with the robots.txt file; b) the prior written permission of keptwoman.net; c) applicable law allowing such actions.
Collect any information that can be used to identify a person, such as usernames. Such actions can be performed only with the permission of this person or in the cases specified in paragraph 3.
Use the Service to distribute unwanted materials of an advertising or commercial nature and other unwanted, imposing materials (spam).
Use the services of third parties to artificially increase the number of views, likes, subscribers and other statistical indicators of pages and communities, as well as independently perform actions that interfere with accurately measuring the actual interest of viewers in the content.
It is groundless to blame other users by submitting false complaints, flagging content as inappropriate, filing copyright infringement complaints, and appeals and objections.
Run contests using the Service that do not comply with the keptwoman.net Rules and Guidelines for contests.
Use the Service to reproduce Content for any purpose other than personal and non-commercial. For example, publicly display photos, videos using the Service.
Use the Service a) to sell any advertisements, sponsorships or promotions posted through the Service or through the Content, except as provided in the Advertiser Rules, such as allowed product placement; b) to sell advertisements, sponsorships or promotions on a page of any site or application where only the Content of the Service is contained, or where it is the main one (for example, selling ads on a page where videos are the only valuable content).

Reservation of rights

Any rights not expressly granted to you by this Agreement remain with keptwoman.net or the respective copyright holders. Thus, using the Service, for example, does not give you intellectual property rights to the Content you access (including any means of customization used or displayed in the Service).

Changes to the Service

We are constantly working to improve our site and may make changes to the operation of the Service, terminate it or disable any functions. Changes can be aimed at improving the functioning or increasing the security of the site, changing the functionality and available tools. Also, innovations are carried out to ensure compliance with legislation, prevent illegal actions and protect the system from intruders. We always consider how the change will affect our users. If reasonably possible, we will notify them of material changes regarding the use of the Service. Your content behavior

If you have a keptwoman.net account, you can upload Content to the Service. You can use your Content to promote your art or activity. All Content uploaded by you must comply with the Agreement and the law. For example, your Content must not contain the intellectual property of third parties unless you have permission from the person concerned or other legal grounds. You are legally responsible for all Content that you add to the site. We can check it using automated technologies. They are used to help detect the spread of spam, malware, illegal materials, and to prevent other illegal activities.

Rights granted by you

You retain all rights to your Content. However, you agree to grant the following rights to keptwoman.net and other users of the Service.

Keptwoman.net rights

By uploading Content to this site, you grant keptwoman.net a non-exclusive, transferable, royalty-free license to use your Content worldwide, with sublicense rights. keptwoman.net obtains, among other things, the right to reproduce, distribute, modify and display your Content in order to develop, operate and improve the Service.

Rights granted to other users

You grant each user of the Service a non-exclusive, royalty-free, worldwide license to access and use your Content within the limits permitted by the functionality of the Service (including the right to reproduce, distribute, modify, display and demonstrate).

License validity period

The rights to use your Content remain in effect until it is removed as described below. After its removal, licenses are terminated, unless otherwise required for the operation of the Service, use of the Content in accordance with the permissions granted before removal, or required by law. … If you remove the Content, keptwoman.net is not obliged to delete either: a) copies saved by users for offline viewing; b) copies, the storage of which is due to legal purposes.

Removal of Content from your side

You can request removal of your Content at any time. In addition, you may make a copy of the Content before deleting it. Please note that you will need to remove Content if you lose the rights required under these Terms.

Removal of Content by keptwoman.net

If we have reason to believe that your Content violates the terms of this Agreement or may harm the keptwoman.net website, its users, or third parties, then we may remove the content or its individual fragments. In this case, you can (at your request) receive an explanation of the reason for the deletion, unless it can a) violate the law or an order of law enforcement agencies or create or increase the risk of imposing legal liability on keptwoman.net; b) jeopardize the reputation or operation of the Service or investigation; c) harm any user, a third party, keptwoman.net.

Copyright protection

The Copyright page on keptwoman.net provides useful information on how to protect your intellectual property rights on the Internet. If you think that your copyrights have been violated in the Service, please let us know.

We review reports of alleged copyright infringement and act in accordance with the guidelines described. Temporary blocking and deletion of an account

Deleting your account

Software in the Service

Downloadable software

If you need to install software to work with the Service, you give permission for automatic updates. It will be automatically installed on your device (in accordance with the device settings) when a new function or version appears. Unless the additional license terms apply, keptwoman.net grants you a worldwide, royalty-free, non-assignable, non-exclusive license to use the software by you personally in accordance with this Agreement. You may not copy, modify, distribute, sell or rent any elements of the Software, or reverse engineer or attempt to extract the source code, except as required by law or with written permission from keptwoman.net.

Open source software

Some programs required when working with the Service are distributed under the terms of a free license, which we make available to you. Please read the terms of such licenses carefully as some of their provisions may override this document.

Other legal conditions

Warranty

In providing the services of the Service, we act with due care and professional competence.

Exclusion of Warranties

The terms of this Agreement do not affect your rights under the law, which cannot be excluded or changed by contract. Nothing in this agreement affects the rights that you have as a consumer. Unless otherwise stated in this Agreement and required by law, keptwoman.net makes no guarantees, warranties or promises regarding the Service. In particular, we make no guarantees, warranties or promises regarding the Content on the Service; specific functions and properties of the Service; as well as its accuracy, reliability, availability and suitability for your needs. In addition, we do not guarantee that the Content that you uploaded to the Service will be available and stored there.

Limitation of Liability

For all users: nothing in this Agreement shall exclude or limit the liability of the parties for death, personal injury, fraud or willful misrepresentation, as well as liability that cannot be excluded or limited in accordance with the law.

To the extent permitted by applicable law, keptwoman.net is not responsible for the following:

losses that you did not incur as a result of violation of the terms of the Agreement by keptwoman.net;
Losses that at the time of the conclusion of the Agreement with keptwoman.net were not a reasonably foreseeable consequence of the violation of the terms of the Agreement by keptwoman.net;
Content posted by any user or for their defamatory, offensive or illegal actions.

For business users: if you use keptwoman.net for sales, business support or professional purposes, you are considered a “Business User”. In this case, in accordance with current legislation, the following limitations of liability apply to your cooperation with keptwoman.net:

keptwoman.net is not responsible for lost profits, lost income, lost data, lost chances, loss of anticipated savings, as well as consequential, incidental or punitive damages, whether such damages were foreseeable or not; and
The total responsibility of keptwoman.net for any claims related to the use of the Service cannot exceed 100 euros.

Links to Third Party Sites

The Service may contain links to third party websites and online services that are not owned by keptwoman.net or controlled by us. keptwoman.net is not responsible for such sites and online services. Use caution when following links to third-party sites and online services. We recommend that you familiarize yourself with their terms of use and privacy policy when migrating.

About this Agreement

Modification of the Agreement

We may change the terms of this Agreement, including for legal or regulatory reasons, for security reasons, or to reflect updates to the Service. We will notify you of such material changes in advance and give you the opportunity to review them in advance. However, updates for new features or for legal reasons may take effect immediately and without notice. Changes apply only for the future. If you do not agree with the updated terms of the Service, you must stop using it and remove from the platform all Content that you have uploaded.

Continuation of the Agreement

Even if you stop using the Service, the provisions of the “Other Legal Terms” and “About this Agreement” sections will not terminate for you. In addition, in accordance with the terms of the “License Term” clause, in some cases the licenses received from you will also remain in effect.

Exclusion of provisions

If it turns out that any specific term of the Agreement cannot be enforced, all other provisions will not be affected and will remain in effect.

Concession

This Agreement may be transferred, in part or in full, to an Affiliate or, in the event of a sale to keptwoman.net, to a third party.

Inadmissibility of waiver of rights

If you violate these terms and we do not take immediate action, this should not be construed as a formal waiver and does not mean that we do not intend to assert our rights in the future, including taking certain actions.

Governing legislation

The Agreement and your relationship with keptwoman.net under the Agreement are governed by Russian law. To resolve disputes, the parties can apply to the courts of Russia.

If, according to any peremptory law of your country, it is impossible to resolve the dispute in the court of Russia and in accordance with the norms of Russian law, you can refer the case to a local court and resolve the issue, guided by local legislation.
